The Borough of Clifton Heights

Listed below are some of the Borough Ordinances that are most pertinent to the average resident and are often handled, initially, by the police department. They are summarized for your quick reference.

Dumping Prohibited, Public Property

It shall unlawful for any person to dump, place or deposit any loose papers, waste, waste paper, rubbish, ashes or refuse on any public street, highway or public sidewalk within the Borough unless placed in containers and deposited temporarily for collection and removal.

Dumping Prohibited, Private Property

It shall be unlawful for any person to dump, place or deposit any waste paper, rubbish, junk or refuse on any private property within the borough without the permission of the owner.

Ordinance No. 516, Curfew Established

It shall be unlawful for any minor under the age of eighteen (18) years (such persons being defined for the purposes of this Part as juveniles) to be or remain in or upon any of the streets, sidewalks, parks, public buildings, places of amusement and entertainment or other public places in the Borough of Clifton Heights between the hours of 10:00 p.m. and 6:00 a.m. (prevailing time) on Sunday, Monday, Tuesday, Wednesday, Thursday; and between the hours of 11:00 p.m. and 6:00 a.m. (prevailing time) on Friday and Saturday, unless such juvenile is accompanied by his or her parent, guardian or other adult person having the care and custody of the juvenile or unless the juvenile is performing an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having care or custody of the juvenile.

Ordinance No. 643, Junked and Abandoned Vehicles

The practice of storing or depositing any abandoned or junked automobiles, vehicles, machinery, or discarded equipment of any kind, or parts thereof, in or on any private property, vacant or occupied, within the borough of Clifton Heights shall be deemed to be and constitute a nuisance and is hereby prohibited.

Definition of Abandoned and Junked vehicle includes but shall not be limited to: A junked vehicle providing that such vehicle is not registered with and certified by the police department as a repairable vehicle, it’s engine or motor or any other essential parts are inoperable or have been removed for more than thirty (30) days; It’s tires, or any tire, have been deflated or its wheel, or wheels, have been removed for more than thirty days; It bears no registration plate and/or no official inspection sticker, or any such sticker is nor current by more than thirty (30) days.

Ordinance No. 663, Parking of Trucks, Buses, Truck-tractors and Trailers Prohibited at all times.

It shall be unlawful for any person to park, or allow to remain parked, on any of the streets or highways of the borough, or parts thereof any vehicle other than a passenger car or a truck with a registered gross weight of less than 5,000 pounds and a height of less than 81 inches which shall not include a truck which is used in whole or in part as a commercial vehicle, or which bears any sign, lettering or commercial advertising or which is utilized as a home or office and which shall not include a bus, truck-tractor, trailer, semi-trailer or motor home.

Ordinance No. 658, Dog Barking and Howling

No owner shall allow their dog or dogs to bark or howl excessively where such barking, howling, etc. becomes a public nuisance, particularly during night time and early morning hours.

Excessive barking and/or howling shall be defined as such barking and/or howling which persists continuously for more than thirty (30) minutes. Any owner of such dog(s) found to be engaged in excessive barking and/or howling shall be deemed to be disturbing the rest and repose of the residents of the Borough shall be issued a citation by the appropriate enforcement officer.

SS 4,

No dog owner and/or person having possession, custody or control of a dog, shall allow said dog to defecate upon the gutter, street, driveway, alley, curb or sidewalk in the borough, or upon the floors or stairways of any building or place frequented by the public or used in common by the tenants, or stairways of any public area, or upon private property other than the property of the owner.

Any dog owner or a person having possession, custody, or control of a dog which defecates in any area other than the private property of the owner of such dog shall be required to immediately remove the said feces from such surfaces and either;

            A. Carry same away for deposit in a toilet, or
            B. Place same in a non-leaking container for deposit in a trash or litter receptacle.

Ordinance No. 682, Unlawful to allow Dogs to Run at Large

It shall be unlawful for the owner of any dog or dogs to allow or permit such dog or dogs to run at large in the Borough of Clifton Heights.

Ordinance No. 800, Sex Offender Residency Restrictions

It shall be unlawful for any Sex Offender to establish a permanent or temporary residence within one thousand (1,000) feet of any school, child care facility, common open space, community center, public park or recreational facilities in any zoning district, residential, commercial, industrial or otherwise
